General terms and conditions of sale
PREAMBLE
The website www.blondyberry.com is published by the company ACCS RETAIL & CONSULTING, a simplified joint-stock company with a single shareholder and a capital of 1,000 euros, registered with the Nanterre Trade and Companies Register under number 934 483 975, whose registered office is located at 82 rue Baudin 92300 LEVALLOIS-PERRET.
ACCS RETAIL & CONSULTING publishes and markets the products of the BLONDY BERRY brand.
BLONDY BERRY reserves the right to adapt or modify these General Terms and Conditions of Sale at any time.

THE OBJECT
These general terms and conditions of sale apply to all orders placed on the website www.blondyberry.com and govern the contractual relationship between the company that publishes the website and any individual customer.
Each product offered for sale is accompanied by a detailed description and images intended to best illustrate its appearance. However, these images are provided for illustrative purposes only and cannot guarantee a perfectly accurate representation of the product, particularly with regard to colors, textures, or proportions, which may vary depending on the screen or shooting conditions.
BLONDY BERRY cannot be held responsible for any minor differences between the images displayed on the website and the products delivered. Similarly, the brand disclaims all responsibility for content from third-party sources that may be present on the website.
AVAILABILITY
Products are offered for sale as long as they are visible on the website www.blondyberry.com and while stocks last.
If a product becomes unavailable after an order has been placed, the customer will be notified by email or telephone. The order will then be automatically cancelled and the amount paid will be refunded to the original payment method as soon as possible.
THE PRICE
Product prices are shown in euros, inclusive of all taxes (VAT and other applicable taxes on the date of the order), unless otherwise stated. Prices do not include delivery charges, which are billed separately and shown before order confirmation.
All orders, regardless of origin, are payable in euros.
BLONDY BERRY reserves the right to change its prices at any time. However, products will be billed based on the rates in effect at the time the order is validated, subject to availability.
The products remain the exclusive property of the company BLONDY BERRY until full payment of their price.
From the moment the products are physically received by the customer, the risks of loss or damage to said products are transferred to the customer.
ORDER
Any order placed on the website www.blondyberry.com implies unreserved acceptance of these general terms and conditions of sale.
Order confirmation constitutes acceptance of the terms and conditions and the conclusion of a binding contract between the parties. From the moment of confirmation, the order is considered final and cannot be cancelled.
BLONDY BERRY reserves the right to refuse or suspend any order for any reason whatsoever, including in the event of product unavailability, existing dispute with the buyer, or payment difficulty.
PAYMENT
To pay for their order, the customer has the option of using all the payment methods offered directly on the website www.blondyberry.com at the time of order validation.
The customer guarantees that they have the necessary authorizations to use the payment method chosen when validating the order.
BLONDY BERRY reserves the right to suspend any order processing or delivery in the event of refusal of payment authorization by the competent bodies, or in the event of non-payment.
BLONDY BERRY also reserves the right to refuse to fulfill an order from a customer who has not fully or partially paid for a previous order, or for whom a payment dispute is ongoing.
For deliveries outside the European Union, customs duties or other local taxes may apply. These charges, both for declaration and payment, are the sole responsibility of the customer.
ORDER CONFIRMATION
BLONDY BERRY acknowledges receipt of the order by sending an email to the address provided by the customer when placing the order. This message serves as confirmation that the order has been received.
The customer formally acknowledges and accepts that the order confirmation will be transmitted electronically.
The order confirmation email includes essential order information (products ordered, quantities, prices, delivery address, payment method), as well as any reservations or difficulties related to product availability, delivery times, or the payment method. It also includes the order number assigned by BLONDY BERRY.
RIGHT OF WITHDRAWAL
In accordance with Article L.121-21 of the Consumer Code, the customer has a period of 14 days from receipt of the products to exercise their right of withdrawal, without having to justify reasons or pay penalties.
Products must be returned in their original condition, complete, unworn, unwashed, with all tags and accessories still attached. Any damage to or abnormal use of the products may invalidate the right of withdrawal.
The customer must inform BLONDY BERRY of their decision to withdraw before the expiry of the 14-day period, by sending an email to help@blondyberry.com or by using the returns management platform provided.
For orders delivered within mainland France, BLONDY BERRY will provide a prepaid return label. A flat fee of €5.90, corresponding to postage costs, will be deducted from the refund.
For returns outside mainland France, return shipping costs are the sole responsibility of the customer. BLONDY BERRY does not cover any customs duties or local taxes.
After receiving and checking the returned products, BLONDY BERRY will proceed with the refund of the sums paid within 7 to 10 days, using the same payment method as that used by the Customer when ordering.

DELIVERY
The products are delivered to the address indicated by the customer during the ordering process, within the timeframe specified on the order confirmation page.
Subject to stock availability, the parcel is generally shipped within 3 to 5 working days in mainland France via Colissimo, and within 3 to 9 working days depending on the country internationally via express delivery via DHL (excluding weekends, public holidays and specific periods such as collection launches).
In the event of a shipping delay, the customer will be informed by email, specifying the possible impact on the initially communicated delivery time.
Upon receiving the package, if it shows visible signs of damage, the customer is advised to refuse it or have the damage noted by the carrier. This step is necessary to allow for a refund or replacement of any missing or defective products.
RETURNS - EXCHANGES - REFUNDS
The customer has 14 working days from receipt of the products to exercise their right of withdrawal, without having to give reasons or pay penalties.
For the return to be accepted, the products must be returned in their original condition, unworn, unwashed, undamaged, in their original packaging, with all tags attached and any accessories.
Return requests must be made via our dedicated portal: help@blondyberry.com .
For orders delivered within mainland France, a prepaid return label will be sent to the customer. A flat fee of €5.90, corresponding to the return shipping costs, will be automatically deducted from the refunded amount.

WARRANTIES AND LIMITATIONS OF LIABILITY
BLONDY BERRY's liability for sales made through its website is strictly limited to the amount paid by the customer for the product in question.
BLONDY BERRY undertakes to implement all reasonable means to ensure access to and proper functioning of the site, but cannot be held responsible for damages resulting from the use of the Internet network, in particular in the event of data loss, intrusion, virus, service interruption or other events beyond its control.
All products offered for sale benefit from the applicable legal guarantees, including the guarantee of conformity (articles L.217-3 to L.217-20 of the Consumer Code) and the guarantee against hidden defects (articles 1641 to 1649 of the Civil Code), under the conditions provided by law.
The warranty applies provided the product is used correctly and the care instructions are followed. BLONDY BERRY cannot be held liable for any damage resulting from misuse or lack of maintenance.
LEGAL GUARANTEE AND CONFORMING DELIVERY
In accordance with the provisions of the Consumer Code, and in particular articles L.217-3 to L.217-20, the products sold by BLONDY BERRY benefit from the legal guarantee of conformity.
BLONDY BERRY is committed to delivering products that conform to the order and are fit for the purpose for which goods of the same nature are normally used. Conformity is assessed in particular with regard to the description provided on the website, the characteristics agreed upon contractually, and any public statements made by BLONDY BERRY or its suppliers.
The customer may invoke this guarantee in the event of a lack of conformity existing at the time of delivery, or resulting from the packaging, when the latter is the responsibility of BLONDY BERRY or carried out under its responsibility.
In the event of a proven non-conformity, the customer may request the repair or replacement of the product, or, failing that, a price reduction or the cancellation of the sale, according to the conditions provided by law.
The legal guarantee of conformity applies at no cost to the customer and independently of any commercial guarantee that may be offered.
LEGAL GUARANTEE AGAINST HIDDEN DEFECTS
Regardless of the legal guarantee of conformity, BLONDY BERRY remains bound by the legal guarantee against hidden defects, in accordance with articles 1641 to 1649 of the Civil Code.
This guarantee applies in the event of a hidden defect affecting the purchased product, which would render it unfit for its intended use, or which diminishes its use to such an extent that the customer would not have acquired it, or would have given a lower price, if he had been aware of it.
If such a defect is discovered, the customer has two years from the date of discovery to take action. They can then:
- Either return the product and receive a full refund of the price paid,
- Either keep the product and request a partial refund, as determined amicably or, failing that, by way of expert assessment.
The implementation of the guarantee requires that the product concerned be returned in its original condition, unworn, unwashed, in its original packaging, accompanied by proof of purchase and a written description of the defect found.
Before any return, the customer is required to contact BLONDY BERRY customer service by email at the following address : help@blondyberry.com in order to report the alleged defect and obtain the necessary instructions.
This guarantee applies independently of any commercial guarantee that may be granted by BLONDY BERRY.
INTELLECTUAL PROPERTY
All content on the website www.blondyberry.com, including but not limited to texts, visuals, illustrations, graphics, logos, videos, sound elements, as well as the general structure of the site, are the exclusive property of ACCS RETAIL & CONSULTING, or are subject to a duly acquired license.
Any reproduction, representation, distribution, exploitation or use, in whole or in part, of all or part of the site, by any means whatsoever and on any medium whatsoever, is strictly prohibited without prior written authorization from ACCS RETAIL & CONSULTING.
Creating hyperlinks to the website www.blondyberry.com is not permitted without the express prior consent of the company.
APPLICABLE LAW - JURISDICTION - MEDIATION
These General Terms and Conditions of Sale are governed by French law, regardless of the nationality of the buyer or the country of delivery.
In the event of a dispute concerning the interpretation, performance, or termination of the contract between the client and BLONDY BERRY, the parties will endeavor to reach an amicable solution. If no amicable solution can be reached, the dispute will be brought before the competent French courts, in accordance with the rules of the French Code of Civil Procedure.
In accordance with the provisions of the Consumer Code, the customer is informed of the possibility of using a free mediation procedure in the event of a dispute arising from an online purchase. Recourse to a consumer mediator can be requested after submitting a written complaint that has not received a satisfactory response within 30 days.
